Terms and Conditions– Best of Portugal Weddings

Definitions

For the purposes of these Terms and Conditions, the following terms shall have the meanings set out below:

• Platform / Website: Best of Portugal Weddings, including www.bestofportugalweddings.com, and all associated digital environments, including subdomains, mobile interfaces, applications, integrations, and any current or future online services operated under this brand.

• Operator: Best of Portugal Weddings, operated by Rute Macário as a sole trader registered in Portugal, responsible for managing the Platform and providing the Services.

• User: any individual or legal entity who accesses, browses, interacts with, submits content to, or uses the Platform in any capacity.

• Professional: any supplier, company, freelancer, venue, or service provider in the wedding industry who uses the Platform for visibility, promotion, editorial participation, advertising, or other services.

• Couple: any individual or individuals participating in interviews, testimonials, editorials, or content featured on the Platform as end clients.

• Services: all services provided by Best of Portugal Weddings, including but not limited to subscriptions, editorial participation, advertising, promotional campaigns, content publication, and any current or future offerings.

• Subscription: a paid plan granting access to specific features, visibility, or services on the Platform, subject to the terms defined herein.

• Content: any material, data, or information submitted, uploaded, published, or otherwise made available on the Platform, including but not limited to text, images, photographs, videos, audio, interviews, testimonials, portfolios, comments, metadata, and any related materials.

• User Content: any Content submitted by Users, including Professionals and Couples, whether for publication, editorial purposes, or platform use.

• Editorial Content: any content created, curated, produced, or published by Best of Portugal Weddings, including interviews, storytelling features, campaigns, and collaborative productions.

• Third Parties: any individuals or entities other than the User and Best of Portugal Weddings, including clients, collaborators, service providers, partners, or external platforms.

Acceptance of Terms

  • By accessing, browsing, or using the Platform, the User acknowledges that they have read, understood, and agree to be legally bound by these Terms and Conditions.

    Acceptance of these Terms occurs through any of the following actions:

    • Accessing or using the Platform

    • Creating a profile or account

    • Submitting content, information, or materials

    • Subscribing to any Services or making any payment

    • Participating in editorials, collaborations, or other activities promoted by Best of Portugal Weddings

    If the User does not agree with these Terms, they must immediately cease using the Platform and any associated Services.

    By using the Platform, the User represents and warrants that:

    • They have the legal capacity to enter into binding agreements under applicable law

    • Where acting on behalf of a company or entity, they have the authority to bind that entity to these Terms

    These Terms constitute a legally binding agreement between the User and Best of Portugal Weddings.

Nature of the Platform

Best of Portugal Weddings is an independent digital platform dedicated to content creation, editorial features, visibility, and promotional activities within the wedding industry.

The Platform operates as a media, marketing, and promotional environment and does not provide wedding planning, event organisation, or direct service execution.

In particular:

• Best of Portugal Weddings does not act as an agency, intermediary, broker, representative, or contracting party between Professionals and any third parties, including couples or clients

• The Platform does not guarantee any specific results, including visibility, client acquisition, bookings, financial return, or business opportunities

• Any engagement, negotiation, agreement, or transaction between Professionals and third parties occurs independently and solely at their own risk and responsibility

Content published on the Platform, including profiles, editorials, interviews, and promotional materials, is provided for informational, editorial, and marketing purposes only.

While Best of Portugal Weddings may curate and present content, it does not verify, endorse, or guarantee the accuracy, completeness, legality, or reliability of any information provided by Users or third parties.

Users acknowledge and agree that:

• Any decisions made based on content or information available on the Platform are made at their own discretion and risk

• The Platform is not responsible for the quality, performance, conduct, or delivery of services by Professionals

• Best of Portugal Weddings shall not be liable for any direct or indirect consequences arising from relationships, agreements, or interactions between Users

This clause applies to all current and future services, features, and activities offered by Best of Portugal Weddings.

Services Overview

  • Best of Portugal Weddings provides a range of digital services related to visibility, content creation, editorial production, and promotion within the wedding industry.

    The Platform may offer, from time to time, a combination of free and paid services, including but not limited to:

    • Professional profiles and visibility on the Platform

    • Editorial features, storytelling content, and curated publications

    • Advertising, promotional placements, and brand exposure opportunities

    • Participation in editorials, collaborations, and creative productions (paid or by invitation)

    • Subscription-based services providing ongoing visibility and platform access

    • Custom services, including consulting, creative direction, or other tailored offerings

    • Any additional current or future services, features, or business activities developed by Best of Portugal Weddings

    All Services may be subject to:

    • Specific conditions, requirements, or eligibility criteria

    • Separate agreements, proposals, or service descriptions

    • Availability, capacity, or selection criteria determined at the sole discretion of Best of Portugal Weddings

    Best of Portugal Weddings reserves the right, at any time and without prior notice, to:

    • Modify, update, suspend, or discontinue any Service, feature, or offering

    • Change the scope, format, structure, or availability of any Service

    • Introduce new services or remove existing ones

    The Platform does not guarantee the availability, continuity, or specific outcomes of any Service.

Subscription, Activation and Content Submission

Fees

The Services may include:

• A one-time onboarding fee of €200 (non-refundable), required to initiate the setup, onboarding, and preparation of the Professional’s profile on the Platform

• A recurring monthly subscription fee of €65, granting access to visibility and ongoing services provided by Best of Portugal Weddings

All fees are exclusive of VAT, where applicable.

Activation of Subscription

The onboarding process, including profile preparation and administrative work, begins upon confirmation of payment of the onboarding fee.

Publication of the Professional’s profile is conditional upon the complete submission of all required materials, including the interview.

Best of Portugal Weddings reserves the right to determine when a profile is ready for publication, based on content completeness, quality standards, and internal criteria.

Content Submission Obligations

Upon onboarding, the Professional will receive a welcome email containing instructions and required materials, including an interview and content submission.

The Professional agrees to submit all requested materials within 30 (thirty) days from receipt of such communication.

Failure to submit the interview or any required content will prevent the publication of the profile.

Failure to Submit Content

If the Professional fails to submit the required content within the initial 30-day period:

• Best of Portugal Weddings reserves the right to close the onboarding process or not proceed with profile publication

• Access to the Services may not be activated or may be limited, without giving rise to any right to a refund

If the Professional later wishes to resume the process:

• A new onboarding process may be required

• A new onboarding fee and/or subscription may be required

Payment Obligations

Failure to submit content, including the interview, does not suspend, delay, or cancel any payment obligations related to onboarding or contracted Services.

All fees remain due in accordance with the agreed terms, regardless of whether the profile is completed or the Services are effectively used.

Invited Professionals

For Professionals participating by invitation only:

• Best of Portugal Weddings reserves the right to withdraw the invitation if the required content is not submitted within the defined timeframe

• No obligation of publication or continued participation is guaranteed.

Payments and Financial Terms

General Payment Conditions

All payments for Services provided by Best of Portugal Weddings must be made in advance, unless otherwise agreed in writing.

By purchasing or engaging with any Service, the User agrees to pay all applicable fees in full, including but not limited to:

• Onboarding fees

• Subscription fees

• Editorial participation fees (including paid editorials, workshops, or other paid experiences)

• Advertising or promotional services

• Featured placements or visibility upgrades

• Custom services, consulting, or creative services

• Any additional current or future services offered by Best of Portugal Weddings

All payments are final and non-refundable, except where required by applicable law.

Payments must be made without any set-off, counterclaim, deduction, or withholding of any kind, unless required by law.

Best of Portugal Weddings reserves the right to update or modify pricing at any time. Any changes shall apply to future Services, renewal periods, or new agreements, unless otherwise agreed in writing.

Payments shall be made using the methods made available by Best of Portugal Weddings and in the currency specified at the time of purchase.

Onboarding Fee

The onboarding fee of €200:

• Is mandatory to initiate the onboarding process

• Covers administrative work, profile preparation, content structuring, and resource allocation

• Is strictly non-refundable, regardless of outcome, participation level, content submission, or profile publication

Subscription Payments (versão atualizada)

Subscription fees:

• Are billed on a recurring basis, as agreed at the time of purchase

• Must be paid in full and on time to maintain access to the Services

• Are due no later than the 8th (eighth) day of each billing month, unless otherwise agreed in writing

Failure to complete payment by the due date may result in, at the sole discretion of Best of Portugal Weddings:

• Immediate suspension of Services

• Restriction or removal of visibility and content

• Termination of the subscription without prior notice

Payment Obligations

Payment obligations remain valid and enforceable regardless of:

• Whether the User submits content

• Whether the profile is published or remains unpublished

• Whether the Services are actively used

• The level of participation of the User

• Any delay, omission, or inactivity attributable to the User

No refunds, credits, or compensation shall be granted in such cases.

Failed or Late Payments

If a payment fails, is declined, or is not completed:

• Best of Portugal Weddings reserves the right to retry the payment using the same method

• The User remains fully responsible for completing the payment

• Services may be suspended, restricted, or terminated until payment is successfully completed

Chargebacks and Payment Disputes

The User agrees not to initiate chargebacks or payment disputes without first contacting Best of Portugal Weddings in good faith to attempt resolution.

In the event of a chargeback or unjustified payment dispute:

• Access to Services may be immediately suspended or permanently terminated

• Any associated costs, fees, or penalties incurred by Best of Portugal Weddings may be charged to the User

• Best of Portugal Weddings reserves the right to recover any outstanding amounts through appropriate legal means

Taxes

All fees are subject to VAT or any other applicable taxes in accordance with Portuguese law.

The User is responsible for complying with any applicable tax obligations associated with their use of the Services, where relevant.

Disagreement with the Terms

  • If the User does not agree with any term set forth herein, they must refrain from using the Site or any Services provided.

  • Continued use of the Site or Services after expressing disagreement constitutes implicit acceptance of all Terms.

  • A User who uses the Site or Services despite disagreement assumes full legal and financial responsibility for such use.

  • Best of Portugal Weddings reserves the right to suspend, limit, or refuse access to the Site or Services to any User who does not accept these Terms, without creating any obligation for compensation or indemnification.

Cancellation

Cancellation by the User

  • The User may cancel their subscription by providing at least 30 (thirty) days’ prior written notice to Best of Portugal Weddings, via email or any official communication channel designated by the platform.

    Effective Date of Cancellation

    Cancellation shall take effect at the end of the current billing period following the notice period.

    During this period, access to the Services shall remain active, provided that no outstanding payments are due.

    No Refunds

    All payments made are non-refundable.

    No refunds, credits, or partial reimbursements shall be granted for any billed periods or for Services not used, whether in whole or in part.

    Outstanding Payments

    Cancellation does not affect any amounts already due or outstanding, which shall remain payable in full.

    The existence of any outstanding amounts prevents access to new Services, continuation of the subscription, reactivation of the account, or entry into any new agreement with Best of Portugal Weddings.

    Best of Portugal Weddings reserves the right to refuse reactivation or new subscription requests from any User while any outstanding amounts remain unpaid, regardless of the time elapsed since such amounts became due.

    Effect of Cancellation

    Upon the effective date of cancellation:

    • Access to the Services may be deactivated

    • Visibility of the profile, content, or features may be reduced, modified, or removed

    Best of Portugal Weddings reserves the right to determine the timing and manner in which such changes are implemented.

    Content After Cancellation

    Any content previously published may remain visible on the Platform and may continue to be used within the scope of Best of Portugal Weddings’ editorial, promotional, and communication activities, in accordance with these Terms.

    Reactivation

    If the User wishes to resume the Services after cancellation:

    • A new onboarding process may be required

    • New commercial conditions may apply

    • Reactivation shall always be subject to the absence of any outstanding payments

Editorial Participation

Nature of Editorials

  • Best of Portugal Weddings may organise, promote, or develop editorials, creative productions, photoshoots, campaigns, workshops, or other editorial and promotional initiatives.

    Participation in such initiatives may be:

    • Free of charge, by invitation, partnership, or collaboration

    • Paid, subject to specific commercial terms and conditions

    Invitation-Based or Collaborative Editorials

    Participation in free or invitation-based editorials is subject exclusively to the selection and approval of Best of Portugal Weddings.

    Any invitation, expression of interest, or preliminary collaboration does not guarantee:

    • Participation in the editorial

    • Publication of any content

    • Inclusion in future initiatives

    • Any form of financial compensation, commercial benefit, or specific outcome

    Best of Portugal Weddings reserves the right to refuse, cancel, modify, postpone, or limit the participation of any professional, partner, or collaborator at any time, for editorial, operational, creative, logistical, or strategic reasons, without giving rise to any obligation of compensation or indemnification.

    Paid Editorials

    Paid editorials, workshops, or other paid experiences shall be governed by specific conditions and, where applicable, by a separate written agreement, which may define, among other elements:

    • The scope and nature of the services

    • Fees and payment conditions

    • Obligations of the parties

    • Content usage rights

    • Timelines, postponements, cancellations, and operational conditions

    In the event of any conflict between these Terms and a specific written agreement, the specific agreement shall prevail in relation to the matters expressly regulated therein, with all remaining provisions of these Terms continuing to apply.

    Editorial and Creative Control

    Best of Portugal Weddings retains full editorial, creative, and strategic control over all editorials it produces or publishes.

    In this context, Best of Portugal Weddings may, without any obligation of additional compensation:

    • Define the concept, creative direction, aesthetic, and format of the editorial

    • Select participants, partners, venues, suppliers, and content

    • Edit, adapt, crop, reorganise, reframe, caption, translate, or combine content

    • Determine if, when, how, and through which channels the content will be published, reused, or promoted

    No participant shall be entitled to require final approval, full publication of submitted materials, specific placement, order of appearance, or a defined duration of publication, unless otherwise agreed in writing.

    Participant Obligations

    Participants in editorials agree to:

    • Cooperate in good faith with Best of Portugal Weddings

    • Comply with all deadlines, instructions, schedules, and requirements communicated

    • Provide all necessary materials, information, products, or elements in a timely manner

    • Ensure that they hold all necessary rights, permissions, licences, and consents in relation to any content, products, services, or materials provided

    • Ensure that their participation and submitted materials do not infringe any third-party rights or applicable laws

    Failure to comply with these obligations may result in exclusion from the editorial, non-publication of content, or termination of participation, without any right to compensation, refund, or indemnification.

    Results and No Guarantee

    Participation in editorials, whether free or paid, does not guarantee any specific results, including but not limited to:

    • Minimum visibility or specific exposure

    • Financial return

    • Client acquisition

    • Brand growth or recognition

    • Leads, inquiries, or bookings

    Any potential benefit depends on multiple external factors and is not guaranteed by Best of Portugal Weddings.

    Editorial Content Rights

    Without prejudice to other provisions of these Terms, all content created, collected, edited, published, or promoted within the context of editorials may be used by Best of Portugal Weddings for editorial, promotional, commercial, institutional, and communication purposes.

    This includes, without limitation, use on the website, social media platforms, promotional materials, portfolios, future campaigns, and any other use related to the brand’s activities.

    Unless otherwise agreed in writing, such use shall not be subject to any geographic, temporal, or format limitations.

    Relationship with Other Provisions

    Participation in editorials remains subject, where applicable, to all other provisions of these Terms and Conditions, including those relating to payments, cancellation, content, liability, indemnification, limitation of liability, and force majeure.

Content Rights and License

  • By submitting, uploading, or providing any Content to Best of Portugal Weddings, the User grants Best of Portugal Weddings a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and sublicensable license to use such Content.

    This license includes, without limitation, the right to:

    • Use, reproduce, publish, display, distribute, and communicate the Content

    • Edit, adapt, crop, retouch, translate, reformat, and create derivative works

    • Use the Content across any media, format, or platform, whether existing now or developed in the future

    • Use the Content for editorial, promotional, commercial, marketing, advertising, and branding purposes

    • Use the Content on the website, social media, digital campaigns, paid advertising, third-party platforms, and any other communication channels

    The User acknowledges and agrees that:

    • This license is granted without any expectation of compensation, payment, or royalties

    • The Content may remain publicly available and may continue to be used even after termination of the User’s relationship with Best of Portugal Weddings

    • Best of Portugal Weddings is not required to remove or cease using previously published Content, except where required by applicable law

    The User represents and warrants that:

    • They hold all necessary rights, permissions, and authorisations to grant this license

    • Any identifiable individuals featured in the Content have given all necessary consents, including image and personality rights where applicable

    • The Content does not infringe any third-party rights or applicable laws

User Responsibilities

Users agree to:

  • • Provide information that is accurate, complete, truthful, and kept up to date

    • Ensure that all Content submitted is lawful, appropriate, and in compliance with applicable laws and regulations

    • Hold all necessary rights, licences, permissions, and authorisations to submit, publish, and allow the use of any Content provided to Best of Portugal Weddings

    • Ensure that any identifiable individuals featured in the Content have given all necessary consents, including image rights, personality rights, and data protection permissions where applicable

    • Ensure that any Content submitted does not infringe any third-party rights, including intellectual property, privacy, confidentiality, or contractual rights

    • Refrain from submitting any Content that is false, misleading, unlawful, defamatory, abusive, discriminatory, or otherwise inappropriate or incompatible with the standards and positioning of Best of Portugal Weddings

    • Use the Platform and Services in good faith and in accordance with these Terms

    Users further agree to:

    • Cooperate fully with Best of Portugal Weddings in the event of any claim, complaint, investigation, or dispute related to Content or use of the Services

    • Provide any necessary information, documentation, or clarification upon request

    The User acknowledges that they are solely responsible for all Content submitted and for any consequences arising from its use, publication, or distribution.

Content Removal

Best of Portugal Weddings reserves the right, at its sole discretion, to refuse, remove, restrict, edit, or suspend any Content submitted by Users, at any time, whether before or after publication.

  • This may occur for any reason, including but not limited to:

    • Violation of these Terms and Conditions

    • Infringement of third-party rights

    • Legal or regulatory concerns

    • Content considered inappropriate, misleading, offensive, or inconsistent with the standards, positioning, or editorial direction of Best of Portugal Weddings

    • Operational, technical, or strategic reasons

    Such actions may be taken without prior notice and without any obligation to provide justification.

    The User acknowledges and agrees that:

    • Best of Portugal Weddings shall not be liable for any direct or indirect consequences resulting from the removal, refusal, or modification of Content

    • This includes, without limitation, loss of visibility, business opportunities, revenue, or reputation

    • No compensation, indemnity, or reimbursement shall be due in connection with such actions

Limitation of Liability

To the maximum extent permitted by applicable law, Best of Portugal Weddings shall not be liable for any:

  • • Indirect, incidental, consequential, or special damages

    • Loss of profits, revenue, business opportunities, clients, or expected benefits

    • Loss of data, content, or information

    • Damage to reputation, brand, or goodwill

    • Service interruptions, delays, errors, or technical failures

    • Actions, omissions, or services provided by third parties, including Professionals, partners, or external platforms

    All Services and the Platform are provided on an “as is” and “as available” basis, without any warranties, guarantees, or representations, except those required by law.

    Best of Portugal Weddings does not guarantee:

    • Continuous or uninterrupted access to the Platform

    • Specific results, including visibility, bookings, or financial return

    • Accuracy, completeness, or reliability of any Content

    The total maximum liability of Best of Portugal Weddings, under any circumstances and regardless of the legal basis of the claim (contractual, non-contractual, or otherwise), shall not exceed the total amount paid by the User to Best of Portugal Weddings in the 12 (twelve) months preceding the event giving rise to the claim.

    Nothing in these Terms shall exclude or limit liability where such limitation is not permitted by law, including in cases of fraud or gross negligence.

Indemnification

Obligation to Indemnify

  • The User (or, where applicable, the “Professional”) agrees to indemnify, defend, and hold harmless Best of Portugal Weddings, its sole proprietor responsible for the activity, as well as its collaborators, partners, service providers, and representatives (collectively, the “Indemnified Parties”), from and against any and all claims, demands, actions, proceedings (whether actual or threatened), liabilities, losses, damages, costs, and expenses (including legal fees and court costs), arising directly or indirectly out of or in connection with, regardless of the legal basis of the claim:

    a) Any content, materials, or information submitted, provided, or made available by the User/Professional

    b) Any infringement or alleged infringement of third-party rights, including intellectual property, image rights, privacy, personality rights, or data protection rights

    c) Any breach of these Terms and Conditions

    d) Any misuse, improper use, or unlawful use of the Platform or Services

    e) Any services provided by the Professional to third parties, including clients or couples, whether or not such services were promoted or featured on the Platform

    f) Participation in editorials, collaborations, or any content-related activities

    The User/Professional assumes full and exclusive responsibility for such matters and agrees to indemnify the Indemnified Parties immediately upon request and on demand.

    Notice and Defense

    The Indemnified Parties shall notify the User/Professional, without undue delay, of any claim subject to indemnification.

    The User/Professional shall assume full control and responsibility for the defense of such claim and shall bear all associated costs and expenses.

    Best of Portugal Weddings reserves the right to participate in the defense of any claim, at its own discretion, without limiting or waiving the User’s/Professional’s obligations under this clause.

    Settlements

    The User/Professional shall not enter into any settlement, agreement, or admission of liability that affects the Indemnified Parties without prior written consent from Best of Portugal Weddings.

    Exclusions

    This indemnification obligation shall not apply to the extent that a claim results directly from proven fraud or gross negligence attributable exclusively to Best of Portugal Weddings, where such limitation is not permitted by applicable law.

    Survival

    This indemnification obligation shall survive the termination, suspension, or cessation of the User’s access to the Platform or use of the Services and shall remain in full force and effect for as long as necessary to resolve any claims, disputes, or liabilities arising therefrom.

Suspension or Termination

Best of Portugal Weddings reserves the right, at its sole discretion, to suspend, restrict, or terminate access to the Platform or any Services, in whole or in part, at any time, with or without prior notice.

  • This may occur in situations including, but not limited to:

    • Failure to make any payment when due

    • Breach of these Terms and Conditions

    • Submission of unlawful, misleading, or inappropriate content

    • Infringement of third-party rights

    • Conduct that may harm the reputation, operation, or integrity of Best of Portugal Weddings

    • Failure to comply with editorial, operational, or participation requirements

    • Any misuse of the Platform or Services

    Best of Portugal Weddings may take such action without liability and without any obligation to provide justification.

    Suspension or termination does not affect:

    • Any outstanding payment obligations

    • Any rights or remedies available to Best of Portugal Weddings

    • Any provisions of these Terms that are intended to survive termination

15. Force Majeure

Best of Portugal Weddings shall not be liable for any delay, failure, or inability to perform its obligations where such delay or failure results from events beyond its reasonable control (“Force Majeure Event”).

  • Force Majeure Events include, but are not limited to:

    • Natural disasters, fires, floods, earthquakes, or extreme weather conditions

    • War, terrorism, civil unrest, or governmental actions

    • Strikes, labour disputes, or industrial actions

    • Failures or interruptions of internet services, hosting providers, platforms, or third-party services

    • Power outages or technical infrastructure failures

    • Pandemics, epidemics, or public health emergencies

    • Changes in applicable laws or regulations

    • Any other events that are unforeseeable, unavoidable, and beyond the reasonable control of Best of Portugal Weddings

    During the occurrence of a Force Majeure Event:

    • The affected obligations shall be suspended for the duration of the event

    • Such suspension shall not constitute a breach of these Terms

    • Best of Portugal Weddings shall not be liable for any resulting damages, losses, or disruptions

    Where a Force Majeure Event continues for an extended period, Best of Portugal Weddings reserves the right to suspend, modify, or terminate the affected Services, without any obligation of compensation, indemnity, or refund.

Changes to Terms

Best of Portugal Weddings reserves the right to amend, update, modify, or replace these Terms and Conditions at any time, for legal, regulatory, operational, technical, commercial, or strategic reasons, including in connection with the Platform and any current or future Services.

The most current version of these Terms and Conditions will be made available on the Platform and shall indicate the date of the latest update.

Where changes are minor, non-material, or do not substantially affect the User’s rights or obligations, Best of Portugal Weddings may implement such changes by publishing the updated version on the Platform, and continued use of the Platform or Services after such publication shall constitute acceptance of the updated Terms.

Where changes are material, significant, or reasonably likely to affect the User’s rights, obligations, or use of the Services, Best of Portugal Weddings may provide notice by appropriate means, including through the Platform, by email, or through other official communication channels.Unless otherwise stated, updated Terms shall take effect from the date of publication.

Where required by applicable law, Best of Portugal Weddings may request specific acceptance or take any additional steps necessary before certain changes become binding.

No oral statement, prior communication, or course of conduct shall be interpreted as amending or waiving these Terms unless expressly agreed in writing by Best of Portugal Weddings.

Governing Law and Jurisdiction

These Terms and Conditions, as well as any use of the Platform and Services, shall be governed by and construed in accordance with the laws of Portugal, including applicable European Union regulations, such as the General Data Protection Regulation (EU) 2016/679 (GDPR), where applicable.

Any dispute, claim, or controversy arising out of or in connection with these Terms, the use of the Platform, or the provision of Services — whether contractual or non-contractual — shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal.

This shall be without prejudice to any mandatory legal provisions that may grant jurisdiction to the courts of the User’s country of residence, particularly in matters relating to consumer protection or data protection laws.
